Before taking part in our spearfishing charters or activities, it is important that you both understand and acknowledge the inherent risks that are associated with this activity. Whilst spearfishing is of course an exciting activity, it is also a challenging sport. It is crucial that you recognise spearfishing can be a potentially dangerous activity and that you may encounter a range of hazards.
We are a seasoned team of spearos with years of experience and excellent knowledge of the local area and conditions. We take care of our equipment and when supplied to you as part of your package, we ensure it is in good working order. When you engage us for a guided package, we also do our very best to ensure that you are not engaging in activities beyond your capabilities. However, the ocean and the creatures in it are wild and some factors are naturally beyond our control. By booking and participating in one of our spearfishing charters, you therefore accept and assume all risks associated with this sport, including but not limited to:
- Physical Risks: Spearfishing typically involves swimming and diving in open water, and this comes with inherent risks such as strong currents, waves, unpredictable weather conditions, and a wide variety of marine life. These factors can increase the likelihood of accidents, injuries, shallow water blackout or even drowning.
- Underwater Hazards: There may be risks under the surface such as sharp rocks, submerged objects and the possibility of entanglement in fishing lines or other equipment. These hazards may lead to cuts, abrasions, puncture wounds or other more serious injuries.
- Sea Life: While spearfishing, you may encounter a range of creatures including but not limited to fish (we would hope!), sharks, jellyfish, and other creatures, some of which are potentially dangerous. Certain species of fish are strong and will put up a fight or even attack when you attempt to capture them. This can lead to cuts, bites, stings, or other injuries.
- Equipment Malfunction: The proper functioning of any spearfishing equipment we provide as part of your charter, including spearguns, masks, snorkels, fins, and wetsuits, is vital for safety. Equipment failure, for example as a result of improper use, can lead to injury, accidents, or other possible consequences.
- Group activities: When selecting one of our charter packages that involves hunting with others, it is important to be aware of potential risks associated with being around others. While we do everything we can to create a safe environment, it is impossible for us to eliminate human error or control the actions of other members of the group that may inadvertently put you at risk. It is crucial to acknowledge that individuals may behave in such a way that, despite precautions, could potentially endanger or injure you. Such actions could include unintentional discharge of a speargun, incorrect handling of our or their own equipment, or failure to adhere to our safety protocols. Although policies and safety measures are used to minimise these risks, it is essential that you recognise certain factors remain beyond our control.
It is essential that all participants in spearfishing activities have appropriate knowledge, skills, experience and where necessary, guidance/tuition, to engage safely in this sport. Unless approaching us as a beginner and looking for tuition or guidance, it is strongly recommended that individuals undergo proper training, and adhere to recognised safety practices. It is extremely important that you are honest and open with us about your level of experience and knowledge so that we can make informed decisions about the locations that we visit with you, levels of supervision and activities undertaken.

By voluntarily participating in spearfishing activities, you acknowledge that you have carefully considered the risks involved and are solely responsible for your own safety. You release and discharge any individuals, organisations, or entities involved in organising or facilitating spearfishing activities from any liability for any injury, damage, or loss that may occur during or as a result of your participation.
